1. Identification of the owner and general information.

These Terms and Conditions regulate the access and use of the website www.elmundodemico.com (hereinafter, the Website) owned by PROFUSION TRADING, S.L. (hereinafter, “EL MUNDO DE MICO”), with Tax ID (CIF) B-87408373, and with registered address at Calle Antonio Suárez 10, 28802 Alcalá de Henares, Madrid, as well as the terms of sale of the services and products offered by EL MUNDO DE MICO on its Website.

As a user of EL MUNDO DE MICO, you must fully accept these conditions of use, as well as the various modifications and/or additional legal texts that EL MUNDO DE MICO may include in the future.

2. User Data and conduct on the Website.

In order to purchase the products offered through the Website, Users may choose between:

– Registering in advance: The User may register by completing the form hosted on the Website. The required data (first name, last name, email address, telephone number) are requested in order to process orders and keep the User informed about the progress of the same.
– Purchasing without registering: The User may make a purchase without identifying themselves in advance. During the purchase process, the User must provide EL MUNDO DE MICO with the billing and shipping information necessary to deliver the order.

The User must verify that their data is correct and complete and inform EL MUNDO DE MICO when there is any variation and/or modification to the information provided during the purchase process.

The use of the Website for fraudulent purposes, or related to criminal offenses or illicit activities of any kind, is not permitted.

It is also prohibited to send, use, or reuse illegal, offensive, abusive, indecent, defamatory, obscene, or threatening material of any kind, or material that constitutes a violation of copyright, trademarks, or confidentiality, privacy, or any other right, or is otherwise injurious or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising content, chain letters, mass mailing, or any other type of “spam” and, in general, any type of unnecessary nuisance or inconvenience.

The User undertakes to make lawful, diligent, honest, and correct use of all information or content to which they have access through the Website, and all this under the principles of good faith and with respect at all times to current legislation.

Likewise, the User makes a commitment not to maliciously or intentionally cause damage or prejudice that may impair or alter the Website itself, nor to introduce or disseminate computer viruses that may produce unauthorized alterations to the contents or systems comprising the Website.

3. Orders and conditions of sale.

To make a purchase, the User must be over 14 years of age, or, failing that, must have previously obtained the authorization of their parents, guardians, or legal representatives, who will be responsible for all acts performed through the Website by the minors in their care.

EL MUNDO DE MICO fulfills orders to peninsular Spain, the Balearic Islands, Andorra, and peninsular Portugal.

Under no circumstances will EL MUNDO DE MICO intentionally offer for sale more units than it has available. In the event that the product is not available after the order has been placed, the User will be informed by email or telephone, offering them the possibility of delaying the delivery or replacing the product with a similar one, or, failing that, refunding the amount paid.

4. Prices and payment method.

All product prices indicated through the Website are expressed in Euros and include VAT and any other taxes that may apply.

The User must pay the amount corresponding to their order by credit or debit card (Visa, Mastercard, Amex), by bank transfer, PayPal, Apple Pay, or Google Pay. Once the order has been formalized, that is, after the acceptance of these Terms and Conditions and payment for the order, EL MUNDO DE MICO will always send a confirmation email to the User with the details of the purchase made.

Users are guaranteed that the payment process is carried out with absolute security, in accordance with the required security protocols and services.

Likewise, the User must notify EL MUNDO DE MICO of any improper or fraudulent charge on the card used for purchases, through the “contact” section of the Website, or by sending an email to info@elmundodemico.com, as soon as possible so that EL MUNDO DE MICO can take the appropriate steps.

5. Information about EL MUNDO DE MICO products and services.

The data included on the Website in the product descriptions are based on information provided by the Suppliers and are purely informative.

Therefore, EL MUNDO DE MICO declines any responsibility for the appearance of errors in said information, although it undertakes to take all measures within its power to correct the aforementioned errors or omissions as soon as possible after having been informed of them.

6. Deadlines, place of delivery, and loss.

6.1. Delivery of the product

EL MUNDO DE MICO undertakes to deliver the product in perfect condition to the address specified by the User. In order to optimize delivery, we would appreciate it if the User indicates an address where the order can be delivered during normal business hours.

To avoid delivery incidents (erroneous addresses, impossibility of finding someone at the address, etc.), it is essential to fill out the corresponding form correctly, and it is mandatory to fill in the field regarding the contact telephone number (it is recommended that this be a mobile phone).

EL MUNDO DE MICO will not be responsible for errors caused in delivery when the delivery address entered by the User in the order form does not correspond to reality, is false, or has been omitted.

Without prejudice to the foregoing, EL MUNDO DE MICO undertakes to adopt those measures within its power so that the delivery of orders can be carried out within the agreed time, and if not, as soon as possible, to the recipient's satisfaction.

6.2. Delivery deadline and notification

Where is my order?

All orders placed by 2:00 PM on a business day will be picked up by the transport agency that same day and delivered to you the next business day: If you place the order after 2:00 PM, your order will be processed on the next business day and delivered to you on the subsequent business day, provided the destination is peninsular Spain or Portugal. If the destination is Andorra or the Balearic Islands, delivery will take between 2 and 3 business days.

If you have chosen to pay by bank transfer, your order will be sent when the transaction has been confirmed.

If the User has made the purchase by bank transfer, the delivery period for the product will begin to count from the business day following the confirmation of the deposit of the purchase amount into the EL MUNDO DE MICO account.

EL MUNDO DE MICO informs you that it will not be possible to ship orders to PO boxes.

EL MUNDO DE MICO will not make deliveries or shipments on Saturdays and Sundays, or on national or community holidays.

In the event that the User cannot be located at their address, the courier company will try to leave a notice as possible depending on the type of dwelling, etc., indicating where the order is and how to proceed with its collection.

Shipping is always free if your purchase exceeds €59 and the shipping destination is peninsular Spain or Portugal.
If you want to enjoy free shipping and the destination is the Balearic Islands or Andorra, your purchase amount must be greater than €100.

These are the prices for orders with lower amounts.

– If the destination of the order is peninsular Spain or Portugal, the cost is €4.95.

– If the destination of the order is the Balearic Islands or Andorra, the cost is €8.95.

Unfortunately, we do NOT ship to the Canary Islands, Ceuta, or Melilla due to the high shipping costs for air transport and customs involved. We hope this will be feasible in the future.

6.3. Diligence in delivery

The User must check the good condition of the package in front of the carrier who makes the delivery of the requested product. It is important to have photos for evaluation and subsequent claims to the transport companies.

If the customer detects any anomaly in the product, they must indicate it on the delivery note and at the same time communicate it to EL MUNDO DE MICO by email to the following address:

7. Returns and right of withdrawal.

7.1. Returns due to manufacturing defects.

All products offered through the website will be completely original, unless otherwise indicated in their description.

In case of a defective product, EL MUNDO DE MICO will proceed, as appropriate, to repair, replacement, price reduction, or termination of the contract, which will be free of charge for the customer. The customer must inform the seller of the lack of conformity within two months of becoming aware of it.

In the event that the consumer exercises their right of withdrawal and returns the goods, the purchase price must be refunded no later than 14 calendar days from the date on which the withdrawal is communicated.

7.2. Withdrawal.

You have the right to withdraw from this contract within a period of 14 calendar days without the need for justification.

The withdrawal period will expire 14 calendar days from the day you, or a third party other than the carrier and indicated by you, acquired physical possession of the last of those goods.

To exercise the right of withdrawal, you must notify EL MUNDO DE MICO, with registered office at Calle Antonio Suárez 10, 28802 Alcalá de Henares, Madrid, of your decision to withdraw from the contract by means of an unequivocal statement (for example, a letter sent by post, fax, or email). You may use the model withdrawal form provided below, although its use is not mandatory.

To comply with the withdrawal period, it is sufficient that the communication regarding the exercise of this right by you is sent before the corresponding period expires.

Consequences of withdrawal

In the event of withdrawal by you, we will refund the full amount of the returned item(s) no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract.

We will proceed to make said refund using the same payment method used by you for the initial transaction, unless you have expressly provided otherwise; in any case, you will not incur any costs as a result of the refund. We may withhold the refund until we have received the goods, or until you have provided proof of the return of the same, whichever condition is met first.

You must return or deliver the goods directly to EL MUNDO DE MICO, with registered office at Calle Antonio Suárez 10, C02, 28802 Alcalá de Henares, Madrid, without undue delay and, in any case, no later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract. The deadline will be considered met if you return the goods before that deadline has expired.

You will only be responsible for the decrease in value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion of the right of withdrawal for certain goods

The right of withdrawal will not be applicable to contracts that refer to:

• The supply of goods that may deteriorate or expire rapidly.
• The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery.
• The supply of goods that, after their delivery and taking into account their nature, have been inextricably mixed with other goods.
• The supply of sealed sound or video recordings or sealed computer software that have been unsealed by the consumer and user after delivery.

8. Intellectual and industrial property.

All rights over the content, design, and source code of this Website and, especially, but not limited to, the photographs, images, texts, logos, designs, trademarks, trade names, data included on the Website, and any other intellectual and industrial property rights are the property of EL MUNDO DE MICO, to whom the exclusive exercise of the rights of exploitation thereof corresponds, or where appropriate, EL MUNDO DE MICO has a license or authorization from the authors.

Therefore, and by virtue of the provisions of Law 21/2014, of November 4, which modifies the consolidated text of the Intellectual Property Law, approved by Royal Legislative Decree 1/1996, of April 12, and Law 1/2000, of January 7, on Civil Procedure, as well as Law 17/2001, of December 7, on Trademarks, and complementary legislation on intellectual and industrial property, the reproduction, transmission, adaptation, translation, distribution, public communication, including its mode of making available, of all or part of the contents of the Website is expressly prohibited, in any format and by any technical means, unless EL MUNDO DE MICO grants the User express authorization to do so.

EL MUNDO DE MICO does not grant any license or authorization of use of any kind over its intellectual and industrial property rights or over any other property or right related to the Website, and in no case will it be understood that the access and browsing of the User implies a waiver, transmission, license, or total or partial assignment of said rights by EL MUNDO DE MICO.

Any use of such content not previously authorized by EL MUNDO DE MICO will be considered a serious breach of intellectual or industrial property rights and will give rise to the legally established liabilities.

9. Liability.

EL MUNDO DE MICO does not grant any guarantee and is not responsible, under any circumstances, for damages of any nature that may arise from the access or use of the products or the contents of the Website. Among others, and by way of example and not limitation, EL MUNDO DE MICO is not responsible for the following circumstances:

• For the loss, damage, withholding, or delay in the delivery of the order due to fortuitous causes, force majeure, or acts attributable to the User.
• For the lack of availability, maintenance, and effective functioning of the Website and/or its services or content, excluding, to the maximum extent permitted by current legislation, any liability for damages of any nature that may be due to the lack of availability or continuity of the operation of the Website, such as, for example, errors or delays in access to the Website by the User when entering their data in the order form, the slowness or impossibility of receipt by the recipients of the order confirmation, or any anomaly that may arise and which is unrelated to the good faith of EL MUNDO DE MICO.
• For the lack of utility of the Website or its contents for any service.
• For the content of other Internet pages to which links placed on the Website may direct.
• For the existence of viruses, malicious or harmful programs on the Website.
• For the illicit, negligent, fraudulent, or contrary to these Terms and Conditions or good faith use of the Website or its contents by Users, including any infringement of the intellectual and/or industrial property rights of EL MUNDO DE MICO or third parties.

In any case, EL MUNDO DE MICO undertakes to solve the problems that may arise and to offer all the necessary support to the User to reach a quick and satisfactory solution to the incident.

The liability of EL MUNDO DE MICO before any claim shall in any case be limited to the restitution of the sum paid by the User for the acquisition of the product or contracting of the service. In this sense, and to the fullest extent permitted by current legislation, the company will not assume any liability for indirect damages, and in particular for any loss, damage, claim, liability, expense, penalty, consequential damage, loss of profit, or other concept, however or whenever it may have occurred.

10. Opinions and comments.

Users may participate on the Website with comments, provided that their content is not illicit, inappropriate, obscene, abusive, threatening, false, defamatory, does not invade the privacy of third parties, does not infringe upon intellectual property rights, or is otherwise injurious or objectionable to third parties, and provided that the content does not contain computer viruses, political propaganda, advertising content, chain letters, mass mailings, or any other type of "spam."

EL MUNDO DE MICO may remove from its Website any comments that infringe upon the rights of EL MUNDO DE MICO or third parties, as well as these Terms and Conditions.

11. Modifications.

The information appearing on this Website is that which is in effect on the date of its last update. EL MUNDO DE MICO reserves the right to update, modify, or delete information on this Website, as well as these Terms and Conditions, the privacy policy, or any other information.

The modifications to the terms and conditions shall enter into force from the moment of their publication on this Website.

12. Nullity and effectiveness of clauses.

If any clause included in these Terms and Conditions is declared, in whole or in part, null or ineffective, such nullity or ineffectiveness shall affect only said provision or the part thereof that is null or ineffective, with the remainder of the clauses subsisting, and such clause, or the part thereof that is affected, shall be considered as not written.

13. Applicable law and jurisdiction.

These Terms and Conditions are subject to Spanish law. The parties, in accordance with Royal Legislative Decree 1/2007 of 16 November, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, submit themselves to the Courts and Tribunals of the User's place of residence.

Users of the Website are aware of everything stated and accept it voluntarily. If a competent court considers that any provision or provisions of this agreement are contrary to the law, such provision or provisions will be drafted again in such a way as to reflect as faithfully as possible the intentions of the parties, while the other provisions will remain in force and applicable.
